Litigation, Municipal Law and Land Use Planning, Wills and Estate Planning, Corporate and Commercial
John Hart has developed a diverse practice since his call to the Bar in 1982. From a general corporate and commercial standpoint, John has negotiated and closed many transactions involving, among other things, the sale, purchase and leasing of assets, shares and real estate. In terms of his litigation practice, John has appeared as counsel in all levels of Court in Ontario on numerous occasions, acting on behalf of municipalities, individuals and corporations in pursuit and defence of claims. Several of John’s cases have been reported in various legal publications. As well, John has appeared before Committees of Council and Councils of various municipalities to provide both general and file specific advice.
John graduated from Queen’s University with a Bachelor of Commerce degree and received his law degree from Osgoode Hall Law School. After his call to the Bar, John worked at Price Waterhouse in the Chartered Accounting Program. In 1983, he joined the law firm of Beatty & Wood and practised in the areas of real estate, general corporate and commercial law, estates and general litigation.
Since joining the firm in 1989, John has acted for a number of municipalities in Ontario and in the GTA on a variety of matters including related to Litigation (insurance defence, municipal dumping matters, injunctions against ratepayers for alleged by-law breaches), Finance (tax and collection matters, tax sales and assessments), Enforcement (prosecutions, appeals, injunctions and contempt orders), Planning (official plan, zoning and minor variance appeals), Works (contractual and tender disputes, and construction liens), Freedom of Information requests and challenges, and Real Estate (purchase and sale of properties, preparation and registration of development and other agreements).
In addition to his significant municipal practice, John also maintains a litigation practice that focuses primarily in the areas of commercial and estate litigation.
Over the years, John has spoken at conferences on the subject of municipal enforcement matters under the Building Code, the Fire Code and Municipal Act of Ontario.
